A Brief Guide to Applying for Child Support Services in Virginia

2 min read

In the state of Virginia, each of the parents is equally responsible of taking care of the financial needs of the minor children. The court sees that the parties have agreed on a fair division of income and assets.

As per Virginia law, the noncustodial parent has more financial obligation. There are situations where the non-custodial parent can’t pay the deemed amount. You can get the help of reputable child support law firm to handle the situation. The three types of custody are:

  • Sole custody: The child lives with one parent for most part of the year
  • Shared custody: The child lives with each parent for at least 91 days a year
  • Split custody: The couple has more than 2 or more children where each parent has custody of minimum 1 child for most part of the year.

Every family has different situations and hence child support is calculated differently for each family. Court will look for many factors including the net monthly income of each parent, number of children and alimony before determining the amount. The court makes sure the children’s expenses regarding food, shelter, healthcare and education are covered.

Applying for child support services:

The Division of Child Support Enforcement (DCSE) assists parents seeking a child support order. Families receiving public assistance like Medicaid are considered automatically eligible by DCSE to apply for services. Other families have to submit an application to apply for services and their application must be affected before they seek the help of DSCE regarding child support.

The DSCE issues an Administrative Support Order (ASO) which is served upon the non-custodial parent. If the parent doesn’t agree with the child support order, he/she has 10 days to object to it and apply for an appeal process.

Appealing for child support:

The non-custodial parent has the right to ask the court to lower or raise the custody support award. The parent may have children from another relationship and need to take care of the expenses of those children. Modification is made on a child support order also if there is a change in financial situation of either of the parents.
